THE MEDICAL MALPRACTICE IN CALIFORNIA,IS THE FINAL OUTCOME OF A VERY COMPLEX AND QUITE INCOMPETENT HEALTH CARE SYSTEM, SUSTAINED BY SPURIOUS ECONOMIC INTERESTS . A CROSSROADS, A CONFLUENT POINT WHERE MERGE TO GATHER INSURANCE CARTELS,HEALTH CAREGIVERS: HOSPITALS+ PHYSICIANS+ NURRSES ASSOCIATIONS WITH LEGISLATORS AND POLITICIANS. TO COMPLETE THE PICTURE OF SAID STATE OF SITUATION,THE REGULATORY-CONTROL BOARDS MOSTLY DEDICATED (PEERS CONTROLLING PEERS)TO MISLEAD AND TO VEIL THE TRUE FACTS EMERGING FROM HUNDRED OF THOUSANDS OF MALPRACTICE AND WRONGFUL DEATH COMPLAINTS WHICH ARE FINNALY DISMISSED AFTER YEARS OF "STAGING" AN APPARENT SERIOUS INVESTIGATION. (3,5 YEARS IS MOSTLY THE AVERAGE). JUST A CYNICAL COVERAGE TO PRETEND A TRUE FULFILLMENT OF LEGAL RULES.

THE MEDICAL BOARD OF CALIFORNIA AND THE REGISTERED NURSING BOARD,ARE TWO INEFFICIENT AND BUREAUCRATICS GOVERNMENT OFFICES .WHICH IN ORDER TO HIDE AND PROTECT WRONGDOERS ,HAVE NO HESITATION TO VIOLATE THE PATIENTS RIGHTS WHICH ARE NOTHING ELSE THAN HUMAN RIGHTS . AFTER DEALING WITH BOTH AGENCIES FOR MORE THAN 7 YEARS, I FEEL FREE TO STATE THIS . MEANWHILE AND AS A DIRECT CONSEQUENCE OF THIS MACHIAVELIAN COCTEL ,THE QUALITY OF CARE SINKS DEEPER DAY AFTER DAY,YEAR AFTER YEAR ....AND THE WORSE PART: PEOPLE DIES DUE TO THE CRIMINAL INCOMPETENCE OF MANY DOCTORS AND NURSES... WITHOUT ANY DISCIPLINARIAN ACTIONS.

WHEN I SAY THAT IN MY OPINION, POLITICIANS AND LEGISLATORS ARE RESPONSIBLES, I MEAN THAT THEY ARE RESPONSIBLES ABOUT SOME "BARGAIN" LEGISLATION. LET´S SEE ONE AMID MANY OTHERS.:THE MEDICAL PRACTICE ACT OF THE BUSSINES AND PROFESSIONAL CODE, FOR EXAMPLE, NEEDS "LEGISLATIVE WORK." TO EXCLUDE FROM IT SEVERAL CLAUSES WHICH GEOPARDIZE PEOPLE´S RIGHTS. WHAT OTHER CAN WE SAY ,FACING THE EXISTING INDEFINABLE & SHADY DEFINITION OF "SINGLE DEPARTURE" OR "GROSS DEPARTURE" ,....FROM STANDARDS, WITHOUT ANY CLEAR DEFINITION TO QUALIFY SAID DEPATURES FROM STANDARD.?? ON THE CONTRARY,SAID DEFINITIONS ARE REAL "BLACK HOLES" . MOSTLY EVERY CASESCAN BE QUALIFIED AS SINGLE DEPARTURE ......TO BE DISMISSED. DOESN´T MATTER IF CAREGIVER COMMITTED A LOT OF FAILURES. THE BOARD´S ANALYST CAN GET ONLY ONE SIMPLE FAILURE,,THE EASIER, TO QUALIFY AS SINGLE DEPARTURE A CASE. FOR INSTANCE: IN MY DAUGHTER´S CASE,WITNESS EXPERTS LISTED A LOT OF GROSS FAILURES BUT NO ONE of the true facts,AS MAIN CAUSE. Let´s see the true failures: FAILURE TO DIAGNOSE,WORSE THAN THAT: NOR NURSES NEITHER PHYSICIANS FIGURED OUT WHAT WAS OCCURING WITH HER , AND AS A DIRECT AND LOGICAL CONSEQUENCE OF THE AFORESAID IGNORANCE : LACK OF ACCURATE TREATMENT AND ACCURATE PRESCRIPTIONS. THAT´S WHY VERONICA DIED.Their ignorance killed her. IN MY HUMBLE OPINION,A MALPRACTICE CASE INVOLVING THE PATIENT´S DEATH ,CANNOT BE CONSIDERED from any point of view A SINGLE DEPARTURE OF STANDARDS..moreover what "the hell" standards ?? STANDARDS ARE USEFUL TO ASSURE SAFETY TO PATIENTS IF SPECIFICATED RULES, SCIENTIFICAL RULES are ACCOMPLISHED IN A CORRECT MANNER. IN MY DAUGHTER´S CASE, and giving an indulgent opinion,THE BOARDS COMMITED QUITE A FELONY QUALIFYING AS SINGLE DEPARTURE THE GROSS FAILURES OF NURSES,PHYSICIANS AND HOSPITAL AUTHORITIES. DESPITE Six(6 )RENOWNED EXPERTS´S REPORTS WE´VE CONSULTED .EXPERTS WERE COINCIDENT QUALIFYING VERONICA´S DEATH AS A CASE OF VASTE MEDICAL IGNORANCE.SHE WAS A HEALTHY WOMAN AND SHE WAS MURDERED BY UNSKILLED PEOPLE.. BUT, NOTWITHSTANDING CLEAR EVIDENCE,THE MEDICAL BOARD´S LAST CONCLUSION WAS: SINGLE DEPARTURE OF STANDARDS BECAUSE THE PHYSICIAN DID NOT PERFORMED JUST A SIMPLE URINE ANALYSIS !!!(THE FACT THAT A SIMPLE FRESH BLOOD TRASFUSSION TO INCREASE PLATELETS LEVELS WAS NOT PERFORMED AS INTERNATIONAL MEDICAL PROTOCOLS POINT AS FUNDAMENTAL,WASN´T CONSIDERED AS A GROSS FAILURE BY THE BOARD´S ANALYST ,AND THIS IS JUST ONE AMID A LOT OF GROSS FAILURES) . ALLOW ME TO ASK (TO THE BOARD´S INVESTIGATORS ) JUST A SIMPLE QUESTION: WHAT KIND OF DIAGNOSIS AND ACCURATE TREATMENT HAS BEEN PERFORMED IN THIS CASE ? iF THEY CAN RESPOND THIS SIMPLE QUESTION IN AN ACCURATE WAY I WILL ABANDON MY FIGHT....BUT I KNOW THEY CAN´T

My name is Roberto Glaubach. I am an architect and I live in Buenos Aires, Argentina . Although I`m not american citizen I have a strong affinity with the USA. All my cousins,descendants from my grandmother`s brother are 4th generation of american citizens and they all live across the country. My grandaughter Indiana Agote-Glaubach was born in USA and she lives in LA with her father José

Agote These are just few first words to introduce myself and my site in which I will try to explain as clearly as possible my objectives and proposals to fight against the medical malpractice and to make patients rights prevail before the unfair and colluded existing system in which killing a patient due medical ignorance is not as important to the authorities as the protection of wrongdoers . First of all I`ll post "the story of an avoidable death" and thereafter I will state my proposals and further objectives of this site which I hope will be helpful to patients and people in general. I apologize if some language mistakes are commited so I beg your forgiveness from the very beginning .

Why VERONICA SOLANGE GLAUBACH,my daughter, should be alive ? Who and What killed her ?Why ? This is the story of an avoidable death,a wrongful death still with no punishment for the responsibles,who are being protected by the cinism of the Medical Board of California with the "green light" of the deputy Attorney General of California.

Part I.

On June 30 th ,2002,my daughter Veronica Solange Glaubach ,a healthy 28 years old girl died at Pasadena`s Huntington Memorial Hospital , a high-tech facility as stated in the hospital propaganda some few hours after having delivered my grandchild Indiana Agote-Glaubach She was absolutely healthy but at the time of being registered at the hospital she was suffering of a mild preclampsia as stated on pre-natal records submitted to the hospital at the time of admittance. Nobody took even a short look over them,as we `ll see.

I agree with this title: just a miracle is needed to avoid medical malpractice. in many facilities. So people must be warned about that. Very awfull but simply true existing medical malpractice epidemic in USA.

She delivered a little girl with a 2,029 kg (IUGR) weight at 6.00am,it was more than clear that it was a case of IUGR (intra uterin growth retardement),one of the main symptoms of preclampsia, thereafter at 12.00 am she started with terrible pain and suffering . She rested unattended during three "golden" hours, in which no one physician was available, particularly the gynecologist Geronimo Rodriguez responsible during labor who was unsuccessfuly paged for a three hours while,after seven hours during which nobody at the hospital due an accurate and wellknown standard management and treatement to stop the eclampsia in progress to HELLP she seized,collapsed and died amid a general bleeding with no one blood platelet (any blood transfussion was prescripted or performed indeed)

That`s a real truth, there`s no doubt. They sent my daughter Veronica up there, Indeed!!!

The immediate main cause of death stated by the hospital authorities was :brain hemorrage heading her to a brain death. I wasn`t there. My daughter was accompanied by her mother and boyfriend,the father of the child. I was going to travel two days after the birth due to previous work compromises. i`m still suffering and regretting myself about that.

As soon as I had been told about the terrible notice I flew immediately to California in the first plane available. Late. Very late. She was there,on the ER`s bed, seemed like sleeping,connected ...and brain dead . No one of us knew at that moment what to do, what to ask, what to think about . We were absolutely arrased and broken. At that moment everything seemed like the result of an unfortunate outcome .Nobody imagined at that point that the true facts of that cruel story were going to emerge soon,very soon.

While we were surrounding our daughter`s body ,suffering,crying ,suddenly came to the room a nurse asking us ,on behalf of the hospital authorities,for a meeting.

We went to a meeting room,where a representative, Michael Gurevitch,MD headed a conference accompanied by other three individuals (no name or introduction given) .He started with the usual step phrases of condolence untill we started asking what caused our child death. He was evasive. He avoided any accurate explanation telling us that at the time he was paged to the ICU was very late ,nothing to do. I asked several times for instance why did a blood transfussion hasn`t been done. Well,because your daughter`s type of blood was rare !!! Allow me to say: the type of blood of Veronica was AB Rh+ which nevertheles in a first level hospital like Huntington Memorial it have no relevance because of course any kind of blood must be available at blood`s bank. So what kind of stupidity was Gurevich trying to make us swallow ? (blood transfussion is a standard treatement in preclampsia when plattelets come down) I responded asking Gurevitch if he thought that he was talking with ignorant people or somebody alike.

At that exactly point,I sharply realized that something wrong happened,so I flew out to the medical record`s office to obtain immediately the records of my daughter The attendant started with evasives so I strongly demanded right there a full copy of the records. I was really upset and I`m sure they realized that otherwise they give me said copies they surely will going to get a huge trouble.

Gurevich also stated that an authopsy wasn`t necessary and showed us a coroner`s certificate which time after our experts reviewers considered as false and discovered that it has been delivered via e-mail. So how could the coroner knew that it wasn`t a coroner case having never seen the body?

Which was the objective of such a lie? We realized said objective as soon as the meeeting finished. A "One Legacy (Organ donor organization) representative entered to the room,sat down aside me and started a speech to convince us to became donors,a gift of life. You may imagine our desorientation at that exactly point . Impossible to describe the feelings. Impossible to think anything accurate. Just the idea that donation was going to let some of our daughter still living. We agreed to donation.

Now we know that the Hospital was deeply concerned about that point. Donation is just a business and surely valuable for the hospital. That`s why authopsy was inconvenient,inopportune.

Now we realize that had we refused to allow a single minimum change on the aforesaid situation, I mean,for instance, refuse to disconnect our daughter ,surely the Hospital had had a trouble to maintain her life signs for who knows how long, and with who knows how considerable expenditures indeed . Maybe that was the correct way to allow us to regain our breath and to clarify our ideas ,allowing us at the same time to put pressure to unveil the true facts which leaded vero to death, the real true about the incredible gross malpractice commited with our poor daughter,malpractice ,which has been probed by several witness experts,time after.
